The Court stated, "A prima facie case has been established in favor of the Plaintiffs and against the Defendants. The balance of convenience also favors the Plaintiffs and is against the Defendants. Allowing the Defendants to continue publishing the infringing posts and videos would result in irreparable harm to the Plaintiffs."
Furthermore, the Court issued an injunction restraining the Defendants from exploiting Rajat Sharma's name, likeness, or persona in any manner, including through the use of artificial intelligence technology.
The unauthorized use of the registered trademarks of "India TV" for both personal and commercial purposes, as well as the sharing or hosting of copyrighted material owned by the plaintiffs, was also prohibited. Furthermore, Meta Platforms was instructed to remove specific infringing content and provide the identities of the individuals responsible for the violations.
Advocate Saikrishna Rajagopal, representing Sharma and India TV, argued that Sharma is a distinguished journalist and public figure, widely recognized for his significant contributions to Indian journalism. He emphasized Sharma's prominent role as the host of popular TV programs such as "Aap Ki Adalat" and "Aaj Ki Baat," and his established reputation for credibility and trustworthiness.
Counsel further asserted that the defendants utilized AI-generated content to falsely portray Sharma as endorsing fraudulent health remedies for conditions such as diabetes and joint pain. This, he argued, constituted a serious violation of Sharma’s personality rights, posing substantial risks to his reputation and misleading the public.
